President Yoon hinted that he may Exercise his Veto over Two Special Prosecutor Bills and a Local Currency Bill passed by the opposition party alone.

President Yoon Seok-yeol, who returned from his visit to the Czech Republic, is expected to exercise his veto on the ‘two special prosecutor Bills’ and the ‘Local Currenc Bill’ that the opposition party passed alone on the 19th.

This is because President Yoon has already vetoed the “Kim Keon-hee Special Prosecutor Bill” once and the “Corporal Chae (Sang-byung) Special Prosecutor Bill” twice out of the two special prosecution acts, and the “Local Currency Bill” was publicly opposed by Minister of Government Administration and Home Affairs Lee Sang-min through a press briefing, saying, “The government is difficult to accept the bill.”

In addition, the ruling People Power Party is also known to have suggested that President Yoon exercise his veto (request for reconsideration). 

Therefore, if President Yoon exercises his veto on these three bills, he will have vetoed a total of 24 bills since the beginning of his official term (see Table 1 below for details).

For reference, this is more than the total number  of vetoes exercised by all former presidents since President Park Chung Hee (total 21 cases).

Note: From President Park Chung Hee to President Moon Jae In, the total number of bills on which the ‘presidential veto’ was exercised during their term was 21. 

However, it seems that President Yoon’s veto will not end here.

This is because the ‘4 Broadcasting Bills’, ‘Yellow Envelope Bill’, and ‘250,000 Won Support Bill for All Citizens’ are scheduled to be re-voted at the plenary session of the National Assembly on the 26th.

Under the current Constitution, if the President has an objection to a bill that has been passed by the National Assembly and transferred to the government, he/she can request the National Assembly to reconsider it (veto) by attaching an objection within 15 days (Article 52② of the Constitution).

In addition, the National Assembly can re-decide the bill with the attendance of a majority of the current members and the approval of more than two-thirds of the members present* (Article 53④ of the Constitution). 

* 200 seats when all members of the registered parliament attend, and if some of the members of the People Power Party (108 seats) do not help, it is virtually impossible to re-decide.

Of course, if it is rejected at this time, the bill will be automatically discarded.

Given the current situation, it seems certain that the opposition party will put these bills on the agenda again and process them alone.

And President Yoon is also likely to exercise his veto on them again.

This is because it is unlikely that President Yoon will accept this bills with the same intent as those he has already vetoed without justification.

尹 대통령, 야당 단독 처리한 쌍특검법과 지역화폐법에 거부권 시사

체코 순방을 마치고 귀국한 윤석열 대통령이 지난 19일 야당 단독으로 처리한 ‘쌍특검법’과 ‘지역화폐법’에 대해 거부권을 행사할 것으로 예상됩니다.

윤 대통령은 이미 쌍특검법 중 ‘김건희 여사 특검법’은 한 차례, 그리고 ‘채 상병 특검법’은 두 차례나 거부권을 행사했고, ‘지역화폐법’은 이상민 행정자치부 장관이 “정부는 법률안을 수용하기 어렵다”라며 언론브리핑을 통해 이 법안을 공개적으로 반대했기 때문이다.

게다가 여당인 국민의힘도 윤 대통령에게 거부권(재의요구권) 행사를 건의한 것으로 알려졌습니다.

만약, 이 세 개 법안에 대해 윤 대통령이 거부권을 행사한다면, 임기 개시 이후 총 24개의 법안을 거부한 셈이 됩니다(상세한 내용은 아래 표 1 참고).

참고로, 이는 박정희 대통령 이후 역대 대통령들이 행사한 거부권 수의 합(合, 총 21件)보다 많은 건수입니다.

그러나 윤 대통령의 거부권 행사는 여기에서 끝날 것 같지 않습니다.

왜냐하면, 오는 26일 국회 본회의에서 ‘방송 4법’, ‘노란봉투법’, ‘전 국민 25만원 지원법’ 등이 재표결될 예정이기 때문입니다. 

현행 헌법上, 대통령은 국회의 의결을 거쳐 정부로 이송된 법안에 이의가 있을 때에는 15일 이내에 이의서를 붙여 국회에 재의를 요구(거부권)할 수 있습니다(헌법 제52조 제2항).

그리고 이에 대해 국회는 재적의원 과반수의 출석과 출석 의원 3분의 2이상의 찬성*으로 재의결(再議決)해 해당 법안을 그대로 확정할 수 있습니다(헌법 제53조 제4항).
* 재적의원 전원 출석 시 200석, 현재 상황에서 국민의힘(108석) 의원들의 일부가 도와주지 않으면 재의결은 사실상 불가능

물론 이때 부결(否決)되면 해당 법안은 자동 폐기됩니다.

현재 상황을 보면, 야당이 이런 법안들을 재상정해 단독으로 처리할 것이 확실해 보입니다.

그리고 윤 대통령도 이들에 대해 재차 거부권을 행사할 것으로 보입니다.

이미 거부권을 행사한 법안들과 동일한 취지의 법안을 윤 대통령이 명분 없이 수용할 가능성이 낮기 때문입니다.
