오는 27일부터, 근로자 50인 미만 사업장(개인사업자 포함)과 공사금액 50억 미만 건설 현장에서도 중대재해처벌법이 적용될 예정이다.
오늘 여야 원내대표(국민의힘 윤재옥, 더불어민주당 홍익표)가 중대재해처벌법의 유예 기간(猶豫期間, Grace Period)을 연장하는 법안(이하 중대재해처벌법 개정안)을 내일 본회의에서 처리하는 것에 대해 논의했지만 합의에 이르지 못했기 때문이다.
중대재해처벌법(이 법률의 공식 명칭은 ‘중대재해 처벌 등에 관한 법률’)은 중대재해를 예방하고 시민들의 생명과 신체를 보호하기 위해 제정된 법률로서 시행 당시(2022년 1월 27일), ‘상시 근로자 50인 미만인 사업 또는 사업장(건설업의 경우 공사금액 50억 미만인 공사)’에는 그 적용을 2년간 유예했었다.

규모가 작은 영세 사업자 등에게 준비할 시간을 확보해 주기 위해서였다.
이 법이 적용되면, 사업 규모가 작더라도 해당 사업장 등에서 노동자가 사망하는 등의 중대재해가 발생할 경우 사고 예방 의무를 다하지 않은 사업주 또는 경영책임자 등이 1년 이상의 징역 또는 10억원 이하의 벌금에 처해진다.
참고로 여기서 중대재해(重大災害, Serious Accident)란 (1)중대산업재해와 (2)중대시민재해로 구성되며 세부 내용은 아래와 같다.

한편, 중소기업중앙회, 대한전문건설협회, 대한기계설비건설협회 등 10여 개 중소기업 단체로 구성된 중소기업단체협의회는 이 법의 유예 기간을 2년 더 연장해 줄 것을 국회에 요구했다.
아직 현장의 준비가 미흡하다는 이유에서다.
고용노동부 장관, 국토교통부 장관, 중소벤처기업부 장관도 오늘 기자회견에 나서, “상시 근로자 5명 이상인 동네 음식점이나 빵집도 중대재해처벌법 적용 대상이 된다”며 “83만7천개 50인 미만 기업에게 준비할 기회를 달라”고 요구했다.
오늘 국회에서 열릴 법제사법위원회(일명 법사위)에서 ‘동 법 개정안’에 대해 여야 원내대표 간에 합의를 해달라는 제스처(Gesture)였다.
물론 노동계는 이와는 다른 입장이다. 노동계는 오늘 국회 본관 앞에서 기자회견을 열고 ‘중대재해처벌법을 예정대로, 추가 유예없이, 확대 적용해야 한다’는 주장을 거듭 표명했다.
그러면서 ‘노동자의 권리와 안전을 가장 앞장서서 보호해야 하는 노동부가 경제 단체만을 대변하는 작금의 상황을 부끄러워해야 할 것’이라며 고용노동부 장관의 인터뷰 내용을 비판했다.
그러나 변수는 있다. 내일 국회 본회의 전에 여야 간 막판 합의가 이루어질 수도 있기 때문이다.
참고로 국민의힘은 이 법의 유예 기간을 더 연장해야 한다는 입장이고, 더불어민주당은 산업안전보건청의 연내 설치를 정부와 여당이 수용한다면 유예 기간 연장에 동의하겠다는 입장이다.

The SAPA is a law enacted to prevent serious accidents and protect the lives and bodies of citizens. When it goes into effect (January 27, 2022), And the application was postponed for two years for businesses or workplaces with less than 50 employees (in the construction industry, construction with a construction cost of less than KRW 5 billion).
This was to secure time for small-scale businesses and others to prepare.
Under this act, even if the scale of the business is small, if a serious accident such as the death of a worker occurs at the relevant workplace, the business owner or manager who fails to fulfill his/her duty to prevent the accident will be subject to imprisonment for more than one year or a fine of up to 1 billion won.
For reference, here, serious accidents consist of (1) serious industrial accidents and (2) serious civil accidents, and the details are as follows.

Meanwhile, the Small and Medium Business Council, which consists of more than 10 small business organizations, including the Korea Federation of Small and Medium Businesses, the Korea Professional Construction Association, and the Korea Machinery and Equipment Construction Association, called on the National Assembly to extend the law’s grace period by two more years.
This is because preparations on site are still insufficient.
The Minister of Employment and Labor (MOEL), the Minister of Land, Infrastructure and Transport (MOLIT), and the Minister of SMEs and Startups (MSS) also held a press conference today and said “local restaurants and bakeries with more than 5 employees are also subject to the Serious Accident Punishment Act,” and demanded that “837,000 companies with less than 50 employees be given the opportunity to prepare.”
It was a gesture to reach an agreement between the floor leaders of the ruling and opposition parties on the “revised bill of the law” at the Legislative and Judiciary Committee (aka the Judiciary Committee) to be held at the National Assembly today.
Of course, the labor community takes a different position. The labor community held a press conference in front of the main building of the National Assembly today and repeatedly expressed its claim that the Serious Accident Punishment Act should be expanded as planned, without additional grace period.
At the same time, an official from the Korean Confederation of Trade Unions (KCTU) criticized the interview with the Minister of Employment and Labor, saying, “The MOEL, which should be at the forefront of protecting workers’ rights and safety, should be ashamed of the current situation where it only represents economic groups.”
However, there is one variable. This is because a last-minute agreement between the ruling and opposition parties may be reached before the plenary session of the National Assembly tomorrow.
For reference, the People Power Party is in the position that the grace period for this law should be further extended, and the Democratic Party of Korea is in the position that it will agree to extending the grace period if the government and the ruling party accept the establishment of the Occupational Safety and Health Agency within the year.
